General Terms and Conditions of Huisdierencrematorium Weesp B.V.
Article 1 - Definitions.
In these general terms and conditions, the following definitions shall apply:
- HC Weesp: Huisdierencrematorium Weesp, located at Flevolaan 19C, 1382 JX in Weesp, registered with the Chamber of Commerce under number 98233815;
- Client: the natural or legal person who has ordered HC Weesp to perform services and/or supply goods;
- Agreement: the verbal or written agreement between HC Weesp and the client regarding the cremation of a pet, with all additional services and supplies;
- Services: all forms of services offered by HC Weesp, including but not limited to: individual, collective or extended cremation (traditional or water cremation), transportation, delivery of urns or ash jewelry, and ash processing.
Article 2 - Applicability.
These Terms and Conditions apply to all quotations, agreements and deliveries of HC Weesp, unless otherwise agreed in writing. Deviations are only valid if confirmed in writing by HC Weesp. Any general terms and conditions of the client do not apply.
Article 3 - Services
All cremation and ancillary services offered by HC Weesp are of a private nature. The presence of third parties is only possible after consultation with and approval of HC Weesp. Employees of HC Weesp shall have access to the premises at all times.
If the client does not make a written or verbal choice of the desired form of cremation (individual, individual extended, collective or water cremation) within three days of the conclusion of the agreement, HC Weesp reserves the right to proceed with a collective cremation.
Article 4 - Forms of cremation
The client chooses one of the cremation forms offered by HC Weesp:
- Collective cremation, possible as both water cremation (resomerization) and traditional fire cremation
- Individual cremation, possible as both water cremation (resomination) and traditional fire cremation
- Comprehensive individual cremation, available only as a traditional fire cremation.
In collective cremation, no ashes are returned to the client.
Article 5 - Rates
Current rates can be found at www.hcweesp.nl or are confirmed verbally and/or in writing upon assignment. All amounts are inclusive of VAT, unless explicitly stated otherwise. HC Weesp reserves the right to adjust rates, provided that the client is notified in advance.
Article 6 - Cancellation
In case of cancellation of the agreement by the client, an administration fee of €5,50 is due. In case of cancellation within 24 hours prior to the scheduled cremation, HC Weesp reserves the right to charge incurred expenses.
Article 7 - Payment
Payment must be made prior to cremation by pin, cash, or invoice within 14 days of invoice date, unless otherwise agreed in writing.
If payment is not made, the client shall be in default without further notice of default. From that moment on, statutory interest shall be due. All extrajudicial and judicial costs will be charged to the client. The extrajudicial collection costs shall be at least €40, in accordance with the Collection Costs Act.
Article 8 - Retention of title.
All items delivered by HC Weesp (such as urns, jewelry, memorial products) remain the property of HC Weesp until full payment is received.
Article 9 - Deadlines
Deadlines for performance of the Agreement are indicative and do not constitute deadlines, unless otherwise agreed in writing. If deadlines are exceeded, HC Weesp shall only be liable after written notice of default.
Article 10 - Ashes Destination
If, in the case of an individual or extended cremation, a choice of ash destination is not made in writing or verbally within three days of the cremation, HC Weesp shall be entitled, after a reminder, to scatter the ashes at a designated location. Client will not receive a separate compensation for this. Ashes must be collected within two months after cremation at the latest, unless otherwise agreed upon.
Article 11 - Suspension and right of retention.
HC Weesp is entitled to suspend its obligations and/or postpone the delivery of ashes or products if the client fails to fulfill its payment obligations or fails to do so in full.
Article 12 - Force majeure
In case of force majeure HC Weesp is not obliged to fulfill its obligations. Force majeure includes power failures, pandemics, government measures, transport restrictions, technical failures or illness of personnel.
Article 13 - Liability
HC Weesp shall not be liable for damages caused by incorrect or incomplete information provided by the client. Any liability is limited to the amount of the order in question. Indirect damage, consequential damage or emotional damage is not eligible for compensation, unless there is intent or gross negligence.
Article 14 - Complaints procedure
Complaints about invoices or services must be reported in writing or by e-mail within 8 days. Failure to report on time will void the right to complain.
Article 15 - Privacy and personal data
HC Weesp processes personal data in accordance with the applicable privacy legislation (AVG). See our privacy statement on

Article 16 - Applicable law and disputes
All agreements with HC Weesp are governed exclusively by Dutch law. Disputes shall, unless imperatively provided otherwise, be submitted to the competent court in the district in which HC Weesp is established.
